New Details in Class Action Lawsuit

(Dakota Dunes, SD) - Five plaintiffs claim negligence, medical malpractice, and intentional infliction of emotional distress in their class-action lawsuit against Siouxland Urology Center of Dakota Dunes, SD. Attorneys filed the lawsuit on Friday. Plaintiffs are asking for $5 Million in damages.

The 22 page complaint says patients "sustained damages arising out of Siouxland Urology's breach of the standard of care by the re-use of certain disposable medical equipment."

Manufactures recommend that equipment, tubes and saline bags used in cystoscopy procedures, be used only once. Siouxland Urology says un sterilized equipment never came into direct contact with patients, but the South Dakota Department of Health says fluid back flow into those tubes present a minimal risk of HIV and Hepatitis infections. It ordered Siouxland Urology to change its cystoscopy practices, and the center is offering free blood tests to the 5,200 affected patients.

An attorney for the plaintiffs said they are not ready to comment on the complaint, and Siouxland Urology said it had not been served the papers as of three o'clock Monday afternoon.
