BREAKING NEWS: South Dakota's smoking ban is going to a vote. The decision came shortly after closing arguments in Pierre, SD Friday. The judge ruled petitioners had 240 more signatures than needed to put the issue on the November 2010 ballot. Both the South Dakota Secretary of State and the American Cancer Society can appeal Friday's decision.
